INTRODUCTION
The introduction of corporate liability under Section 17A of the Malaysian Anti-Corruption Commission (MACC) Act 2009, modelled after Section 7 of the UK Bribery Act 2010, places direct accountability on organisations for corrupt acts committed by employees or associated persons. Under Section 17A(3), organisations, including directors and management, may be held criminally liable even without knowledge or consent of the misconduct, unless adequate procedures are in place. This programme provides participants with a structured understanding of Section 17A requirements, focusing on the concept of “adequate procedures” as prescribed under subsection (5). Participants will be introduced to the T.R.U.S.T. framework and its application in establishing effective anti-corruption controls, risk management practices, and governance systems.
The programme also emphasises practical approaches to identifying corruption risks, implementing preventive measures, and responding appropriately to potential incidents. Participants will gain insights into their roles and responsibilities in safeguarding the organisation, including the importance of risk management, internal controls, and compliance monitoring. Through case-based discussions and scenario-driven activities, participants will develop the capability to apply adequate procedures within their organisational context, reduce legal exposure, and contribute to a culture of integrity, accountability, and sustainable compliance.
